For counsel outside Ontario

Your Ontario counsel, on your timetable.

We act as local agent counsel for law firms in other jurisdictions that need something done in an Ontario court: obtaining evidence from a witness, enforcing a judgment or award, or freezing assets. Subject to local requirements, you keep the client relationship and the case strategy. We take care of the Ontario proceedings and keep you informed throughout.

Nimble, cost-effective and professional Ontario counsel for international law firms.

What we handle

The Ontario step in your case.

Letters of request and evidence

Once your court has issued a letter of request (letters rogatory), we apply to the Ontario Superior Court of Justice to give it effect, so the witness can be examined and documents produced here. We can review the letter before it issues so it is framed for Ontario.

Recognition and enforcement of foreign judgments and awards

We bring the Ontario proceeding to recognize your judgment or arbitral award, then use Ontario enforcement tools to collect.

Asset recovery in aid of foreign proceedings

Freezing orders, disclosure orders against banks and third parties, and tracing of funds that have moved into Ontario, on an urgent basis where the case calls for it.

How an engagement works

Four steps, clearly scoped.

01

Conflict check

Send us the parties and witnesses. We clear conflicts promptly.

02

Scope and retainer

We confirm the Ontario steps, the timing and a budget. The retainer is held in trust.

03

We prepare

We build the Ontario record from your pleadings and materials, including working with translated documents where needed.

04

We file and appear

We serve, appear and report back after each step, in plain terms and in your language if you prefer.

Questions from counsel

Frequently asked.

Does the letter of request need to be issued before we start?

No. The earlier we're involved, the better. We can review the draft before it goes to your court.

How long does it take?

It depends on whether the witness cooperates and on the court's schedule. We'll give you a realistic timeline at intake, so tell us about any tight deadline early.

Who will I deal with?

A senior litigation counsel, directly.

What languages can you work in?

We can work in any language with the assistance of interpreters. Our team speaks English, Spanish, Portuguese and Farsi, and can assist directly in those languages.
